Offences involving death by driving.
Causing death by simple careless driving was introduced on the 18th August 2008
- it carries a mandatory ban and up to 5 years imprisonment.
Causing death whilst disqualified or uninsured was introduced on 128th August 2008
- it carries a mandatory ban and up to 2 years imprisonment.
Causing Death by careless driving whilst under the influence of drink or drugs.
This offence is committed where a defendant whilst driving carelessly (see above) causes the death of a person and is at the time either:
Unfit to drive through drink or drugs,
Is drink driving
Or within 18hours refuses to provide a sample of breath, blood or urine without reasonable excuse.
This offence can only be dealt with at crown court and carries up to 14 years imprisonment. Disqualification for a minimum term of 12 months is obligatory.
Causing death by dangerous driving.
This offence is committed where a person whilst driving dangerously (see above) causes the death of a person.
This offence can only be dealt with at crown court and carries up to 14 years imprisonment. Disqualification for a minimum term of 12 months is obligatory.
